TENANCY FRAUD AND SUBLETTING

Tenancy Fraud is the unlawful subletting of a property, by the registered tenant, to third parties by way of renting the property in return for financial gain. It is a huge problem for many RSL’s, private landlords and estates.

It is said approximately 160,000 social housing properties are being illegally sublet and costs the taxpayer £2 billion per year (Experian)

The illegal subletting of social housing properties can also be a criminal offence and fraudsters can be prosecuted under:

Housing Act 1996 S171 and 214
• Fraud Act 2006
• Prevention of Social Housing Fraud Act 2013
• Proceeds of Crime Act 2002

Fraudsters can be imprisoned and fined and can also be ordered to repay profits from illegal subletting.
